MUNICIPAL COURT
WHAT TO EXPECT

Court is held the second Wednesday of each month at the Monument Town Hall located at 166 Second Street. You will either be summoned to appear at 8:00 a.m. or 9:30 a.m. The court date and time appears on your citation issued by the officer.

For the safety and security of the court, you will be searched by a uniform police officer before entering the court room.

Your first visit to the court will be for an arraignment. You will be advised of your rights and the charge(s) against you.

Defendants who are under the age of 18 must appear with a parent or legal guardian.

The Town Attorney will review your driving record and/or criminal history prior to your scheduled court appearance, and may offer a reduction of points in exchange for pleading guilty to the lesser charge (plea bargain).

A plea bargain offer is based on your driving record, criminal history, and information contained in the officer's notes or accident report. It is solely the Town Attorney's discretion to offer you a plea bargain or not; he is not required to offer a plea bargain.

Once court is in session, the Judge will give a general advisement of rights. The Judge will then begin to call the cases.

When your case is called, you will be asked to approach the podium and you will be advised of the charges in your case. You will then be asked for your plea to the charge or charges. You may enter a plea of either guilty or not guilty.

Once your plea of either guilty or not guilty is accepted, you will be referred to the Court Cashier to complete appropriate paperwork and to pay your fine and court costs.
